Provider Terms of Business

These Provider Terms of Business govern your use of Ontym as a provider of beauty and wellness services. They are in addition to our general Terms of Service and Privacy Policy. Where these Provider Terms conflict with the general Terms on a matter specific to providers, these Provider Terms apply. By listing your services on Ontym you agree to them.

1. Our relationship

You are an independent business. Ontym is a marketplace that connects you with customers and provides the tools to take bookings and get paid. Ontym is not your employer, partner, or agent, and we do not deliver the services you offer. The contract for each service is between you and your customer; you are directly responsible to the customer for the quality and delivery of your work.

For your own account data — your name, contact details, Ghana Card, and payout details — Ontym is the Data Controller, and our Privacy Policy explains how we handle it. For any client list you import into Ontym, the roles are different: you are the Data Controller and Ontym is your Data Processor (see section 3).

2. Importing your existing clients

Ontym lets you bring the clients you already have into the platform so you can keep reaching them — for example to confirm bookings or send appointment reminders. When you import client contact details, you confirm to us that:

  • they are genuine, existing clients of your business;
  • you collected their details lawfully and have the right to contact them;
  • you have the right to share their details with Ontym so we can contact them on your behalf; and
  • the details are accurate to the best of your knowledge.

This confirmation matters. You know your clients and how you obtained their consent; Ontym does not. If you import a list you had no right to use, you are responsible for that, not Ontym (see section 8).

3. Data Processing Agreement

This section is the Data Processing Agreement between you (the Controller) and Ontym (the Processor) for client data you import, under Ghana's Data Protection Act, 2012 (Act 843).

Our instructions. Ontym processes imported client data only to provide the platform to you — storing it, showing it back to you, and sending messages to those clients on your behalf as described in section 4. We act on your documented instructions and do not use your client list for our own marketing or sell it to anyone.

Security. We protect imported client data with encryption in transit and at rest and with access controls that limit who can see it, to the standard set out in our Privacy Policy.

Sub-processors. We use Supabase to host the database in which your client data is stored. When we enable SMS delivery, messages will be sent on your behalf by Arkesel, our SMS sub-processor; we will confirm here when that channel goes live. We remain responsible to you for what our sub-processors do with the data.

Breach notification. If a security breach affects your imported client data, we will notify you without undue delay so you can meet your own obligations to your clients and to the Data Protection Commission.

Deletion and return. When you close your provider account, or on your written request, we will delete or return the client data you imported, except where we must keep some of it to comply with the law.

4. Messages we send on your behalf

Ontym can send messages to your clients on your behalf — appointment reminders (for example that a dental check-up or a regular grooming appointment is due), booking confirmations, and birthday or holiday greetings, together with occasional (never guaranteed) offers where you choose to send them. You decide who is contacted and about what; Ontym sends the message, but the message comes from you.

The first time we contact a client you have imported, that message identifies you and explains how they can stop hearing from you. Every message is opt-out: a client can stop them at any time by replying STOP to any message we send on your behalf. When a client opts out, we honour it across the whole platform, and you cannot override a client's opt-out — not for marketing messages. You authorise the messages; the client's choice to stop them always wins.

5. Your obligations

  • Keep your availability, pricing, and service information accurate and up to date.
  • Keep client details you hold accurate, and respond to your own clients' requests to see, correct, or delete their data — you are their Data Controller.
  • Do not import or upload any data you have no right to use.
  • Deliver the services you list, honestly and to a professional standard, and set a clear cancellation policy on your profile.
  • Do not encourage customers to pay you off-platform to avoid Ontym fees — this takes the booking off Ontym, where there is no booking record or dispute support.

6. Fees and payouts

Payments from customers are processed by Paystack. Ontym never holds your money. When a customer pays for a booking, Paystack splits the payment at the point of sale: your share goes directly to your own Paystack account and settles to your mobile money or bank on Paystack's normal cycle, and Ontym's platform fee goes to Ontym. The platform fee depends on the service category and is shown to you before you list. Your earnings and what has settled are shown in your Ontym dashboard.

Ontym does not process refunds. If a customer cancels or a booking is disrupted, any amount owed back to the customer is a matter between you and the customer, settled directly. Ontym records what is owed but moves no money.

7. Verification and regulated professions

Before you can take bookings, we verify your identity using your Ghana Card and a biometric face-match through Smile Identity. Being ID Verified confirms who you are — it does not certify your skills, training, or qualifications, and Ontym does not present it that way to customers.

If you work in a regulated profession (for example dentistry, regulated by the Medical and Dental Council), you are responsible for holding and maintaining the licences that profession requires. Ontym is a booking platform, not a records system: any patient, clinical, or treatment records remain your own responsibility, kept in your own systems, outside Ontym.

8. Liability and indemnity

To the fullest extent permitted by law, Ontym's total liability to you for any claim arising from your use of the platform is limited to the platform fees you paid to Ontym on the booking that gave rise to the claim. We are not liable for indirect or consequential losses, loss of income, business, profits, anticipated savings, or wasted time.

You agree to indemnify and hold harmless Ontym and ModStack Limited Company against any claims, losses, or costs arising from data you import without the right to use it, messages you authorise us to send, your delivery of (or failure to deliver) a service, or your breach of these Provider Terms.

9. Suspension and termination

We may suspend or close your provider account if you breach these Provider Terms, fail verification, use the platform unlawfully, or put customers or their data at risk. You may close your provider account at any time. Closing your account does not affect obligations already incurred, such as a service already booked or a payout already due.

10. Changes to these terms

We may update these Provider Terms from time to time. When we do, we will update the “Last updated” date above and, for significant changes, notify you by email or in your dashboard. Continuing to offer services on Ontym after changes are published means you accept the updated terms.

11. Governing law and contact

These Provider Terms are governed by the laws of Ghana, and any dispute that cannot be resolved in good faith will be handled by the courts of Ghana. Ontym is operated by ModStack Limited Company (ORC number: CS131070626). For anything relating to these terms, contact us at legal@ontym.co.
