1. Who we are

Ontym is a service of ModStack Limited Company, a company incorporated in Ghana (ORC number: CS131070626). These Terms govern your use of the Ontym platform — the website at ontym.co and the Ontym mobile app (together, “the Platform”).

By creating an account or making a booking, you agree to these Terms. Contact us at legal@ontym.co or by post at [registered physical address].

2. What Ontym is — and is not

Ontym is a marketplace. We connect customers who want beauty and wellness services with independent providers who deliver those services.

Ontym is not the service provider. When you book a service through Ontym, the appointment is a contract between you and the provider. Ontym facilitates the booking and the payment — we are the platform in the middle, not the person doing the work. If something goes wrong with a service, your dispute is with the provider; if you want a refund for a service, you discuss that with the provider directly; and Ontym does not guarantee the quality of any service a provider delivers.

Ontym is a booking platform, not a records system. Ontym does not create, hold, or manage medical, clinical, or professional treatment records. Where a provider is a healthcare professional (for example a dentist), any patient or clinical records remain the provider's own responsibility, kept in the provider's own systems, outside Ontym. Booking notes you add are short messages to help your provider prepare — they are not a medical record, and you should not enter sensitive medical or financial details into them.

3. Provider verification

Providers on Ontym are ID Verified — we have confirmed their identity using their Ghana Card and a biometric face-match through Smile Identity.

ID Verified does not mean licensed, certified, or endorsed. No government body in Ghana currently licenses cosmetologists, hair stylists, nail technicians, or most beauty and wellness practitioners. Ontym cannot certify skill, training, or professional qualifications, and we do not claim to. Where a provider works in a regulated profession (for example dentistry, regulated by the Medical and Dental Council), that licensing is handled by the relevant body, not by Ontym. You are responsible for reading reviews, checking a provider's portfolio, and deciding whether to trust them.

4. Eligibility and accounts

You must be at least 18 years old to create an Ontym account. Your account is personal to you and may not be transferred. You are responsible for keeping your login credentials secure; if you think someone else has accessed your account, contact us immediately at legal@ontym.co. We may suspend or close accounts used for fraud or abuse. Providers are responsible for keeping their availability, pricing, and service information accurate.

5. Bookings and cancellations

When you book a service, you make a commitment to the provider, who reserves time for you. Each provider sets their own cancellation policy, shown on their profile before you confirm. If you cancel, any amount due back to you is determined by that provider's cancellation policy and is settled between you and the provider — Ontym does not process refunds (see section 6). If a provider cancels on you, they are responsible for notifying you promptly and for any amount owed back to you.

6. Payments

Payments on Ontym are processed by Paystack. Ontym never holds your money. When you pay for a booking, Paystack splits the payment at the point of sale: the provider's share goes directly to their own Paystack account and is settled to their mobile money or bank on Paystack's normal cycle, and Ontym's platform fee goes to Ontym. This fee covers the cost of running the platform. Customers pay the full service amount shown at checkout, and providers receive their share, less the platform fee, shown in their Ontym dashboard.

Ontym does not process refunds. Refunds — whether for cancellations, no-shows, or disputes — are a matter between you and the provider.

7. Reviews and user content

You may post reviews, ratings, and photos of services you have received. Reviews must be honest and based on real experience — fake, paid, or misleading reviews are not allowed. By posting content on the Platform, you grant Ontym a non-exclusive, royalty-free licence to display, store, and reproduce that content on the Platform in connection with the service. You remain responsible for the content you post.

8. Things you cannot do on the Platform

  • Create fake accounts or impersonate another person.
  • Post false reviews or pay for reviews.
  • Harass, threaten, or discriminate against anyone.
  • Circumvent the Platform to pay providers directly to avoid Ontym fees (this violates the provider's agreement and takes the booking off Ontym, where there is no verification trail, booking record, or dispute support).
  • Use bots or automated tools to scrape or copy content, reverse engineer the Platform, or circumvent its security.

9. Messages sent on behalf of providers

Ontym may send messages to you on behalf of a provider you have booked with, or whose client you already are. These include birthday and holiday greetings, occasional (never guaranteed) offers, and appointment reminders — for example a reminder that a dental check-up or a regular grooming appointment is due. Ontym sends these on the provider's behalf; the provider decides who is contacted and about what.

If you were already a provider's client before they joined Ontym, that provider may share your contact details with us so they can keep reaching you. The provider confirms to us that they have the right to contact you. Every message is opt-out: you can stop them at any time from your settings or by replying STOP to any message we send you, and we will honour that across all providers.

10. Disclaimers

The Platform and its content are provided “as is” and “as available”, without warranty of any kind. We do not warrant that provider information is accurate or complete, that the Platform will be uninterrupted or error-free, or that any service you book will meet your expectations. Service quality, provider availability, and booking outcomes are the provider's responsibility, not ours.

11. Limitation of liability

To the fullest extent permitted by law, Ontym's total liability to you for any claim arising from your use of the Platform is limited to the amount you paid through the Platform for the specific booking that gave rise to the claim. We are not liable for indirect or consequential losses, loss of income, business, profits, anticipated savings, or wasted time. We will try to help resolve genuine disputes between customers and providers, but our involvement is not legally binding and we do not guarantee any outcome.

12. Indemnity

You agree to indemnify and hold harmless Ontym and ModStack Limited Company against any claims, losses, or costs arising from your misuse of the Platform, your breach of these Terms, or your infringement of another person's rights.

13. Intellectual property

Ontym owns all intellectual property in the Platform, including the website, app, branding, and content we provide. Using the Platform gives you no ownership of it. You may not copy, modify, or reuse our intellectual property without our written permission.

14. Suspension and termination

We may suspend or close your account if you breach these Terms, use the Platform unlawfully, or put other users at risk. You may close your account at any time. Closing an account does not affect obligations already incurred, such as amounts owed for a completed booking.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, for significant changes, notify you by email or in-app message. Continuing to use the Platform after changes are published means you accept the new Terms.

16. Governing law and disputes

These Terms are governed by the laws of Ghana. If a dispute arises, we both agree to first try to resolve it in good faith by contacting legal@ontym.co. Any dispute that cannot be resolved that way will be handled by the courts of Ghana.
